PHOTOGRAPHY SESSION TERMS AND CONDITIONS

Each person using photography services, hereinafter referred to as the "Client," receives a link to these terms and conditions from me, Volodymyr Khomenko Photography, hereinafter referred to as the "Photographer," before the photo session and is required to familiarize themselves with its content. Booking a photo session signifies that the Client accepts all the terms and conditions contained herein, has reviewed the Photographer's portfolio, the style of the presented photos, their artistic editing, and fully accepts them.

1. Photo session booking conditions 

1.1. The date and details of the photo session are arranged in advance through direct contact with the Photographer via phone, email, or through the contact form on www.khomenkophotography.com.

1.2. The packages presented in the offer are basic packages that cannot be reduced. Opting out of any element of the package does not affect the price.

1.3. Before the photo session, the Client must inform the Photographer of the selected package and communicate any additional comments and expectations, which must be confirmed by the Photographer.

1.4. By agreeing to participate in the photo session, the Client acknowledges that they have reviewed the Photographer’s portfolio, accepting the presented work style, types of shots, aesthetic sensibility, and post-production techniques used in graphic programs (e.g., sharpening, color correction, background blurring). This acceptance releases the Photographer from any additional corrections and potential claims after the final photos are delivered unless the Photographer decides otherwise.

1.5. The Client understands that the Photographer does not replicate the style of another photographer.

2. Photo session gift voucher

2.1. It is possible to purchase a session in the form of a gift voucher (for a selected package of available offers). The voucher has a validity of 6 months from the date of purchase and within this time you must make a session. Payment for the selected gift package must be paid on the date of purchase.

2.2. The voucher cannot be exchanged for cash as well as cannot be returned. After 6 months without any contact from the Client, the voucher is lost. Therefore, it is advisable for the recipient to contact the Photographer as early as possible to arrange the date and details of the session. Applying to the Photographer a few days before the end of the voucher's validity does not guarantee the session due to the lack of free dates for sessions.

2.3. Each gift voucher from the offer has a certain number of photos delivered according to the selected package. Additional photos are charged according to the offer price list.

3. Payment Terms

3.1. After scheduling a photo session, the Client is required to review the terms and conditions and provide their full name, surname, home address, e-mail address, contact telephone number and personal ID number (PESEL), which are necessary for the preparation of the photo session agreement and submission of photos for selection.

3.2. The Client is required to pay a deposit of 50% of the chosen service package's price.

3.3. The deposit payment is due within 3 business days from the Photographer's confirmation of the session date. If the deposit is not received within this timeframe, the session date is automatically canceled.

3.4. The remaining 50% of the chosen package must be paid via bank transfer prior to the session day. This payment is a condition for granting the Client access to the secured photo gallery for selection, as well as for the subsequent post-production (graphic editing and/or retouching) of the chosen photos by the Photographer. The final edited photos are provided to the Client according to the timelines specified in the chosen package.

3.5. Travel to the Client's home or an outdoor location is subject to an additional charge, calculated based on taxi fare.

3.6. Payment for additional shots can be made by bank transfer, in accordance with the applicable price list of the selected package.

4.  Rescheduling and Cancellation

4.1. Both the Client and the Photographer are allowed to reschedule the session once, due to illness (fever, cough, cold, or other potentially contagious symptoms) or sudden severe weather conditions in the case of outdoor sessions (heavy rain, snowstorm, thunderstorm, or strong winds).

4.2. If poor weather conditions occur on the scheduled day of an outdoor session, the Photographer will coordinate with the Client to either reschedule the session or conduct it in the studio.

4.3. The Photographer will always confirm the date, location, and start time of the session via email or SMS the day before the session. If the Client does not respond by 10:00 PM on the day before the scheduled session, the Photographer will send a notification canceling the session.

4.4. In the event of unforeseen emergencies on the part of the Client, a one-time free rescheduling is allowed, provided that the Client notifies the Photographer at least three hours before the scheduled session time. Any further rescheduling will need to be agreed upon between the Client and the Photographer. If the Client attempts to reschedule a third time or cancels the session, the entire deposit paid up to that point will be forfeited.

4.5. The Client has the right to withdraw from the photo session agreement and receive the previously paid deposit (50% of the price of the chosen service package), provided that the intention to withdraw from the contract is communicated at least 14 days before the scheduled date of the photo session, via email to the address provided in the contract. If the withdrawal is communicated less than 14 days before the session date, the Photographer reserves the right to retain the deposit (50% of the price of the chosen service package).

4.6. The Photographer has the right to withdraw from the photography session contract and either refund the deposit (50% of the price of the chosen service package) or reschedule the session to a different date, according to the Client's decision, in the event of unforeseen circumstances on the part of the Photographer (e.g., accident, serious illness, family death, epidemiological threat, etc.), as well as loss of data or equipment due to theft, vandalism, breakdown, fire, or flood).

5. Preparation for the Session

5.1. Photography captures the moment, making client engagement during the session crucial. Posing in a way that aligns with the desired outcome and preparing outfits and footwear (styling) ahead of the studio visit is essential.

5.2. The photo session can be conducted either in the studio or outdoors, depending on prior arrangements with the Photographer.

5.3. The duration of the photo session depends on the type of session and the selected package.

5.4. Clients should arrive at the scheduled time agreed upon with the Photographer. There is no need to arrive earlier as the Photographer will be preparing the equipment either in the studio or on location.

5.5. If the Client anticipates being late, they should inform the Photographer in advance via phone call or SMS.

5.6. If the session is to take place in a location that requires an entry fee or a photography permit, the Client is responsible for covering these costs.

5.7. During the studio session, only individuals participating in the photo shoot are allowed to be present.

5.8. In the studio, clients are required to pose either barefoot or in clean, alternate footwear brought specifically for the session.

5.9. Taking photos with a personal smartphone, tablet, or camera during the session is prohibited.

5.10. The Client acknowledges that the final result of the session is influenced by factors such as their preparation (styling, makeup, mood, condition) and their active participation in posing.

5.11. Styling preparation is the Client's responsibility. Neutral colors, simple patterns, and classic, comfortable cuts are recommended. If multiple people are participating in the session, color coordination of outfits is advised.

5.12. Makeup services and hair styling assistance are available for an additional fee, according to the price list of the selected package.

6. Selection and Delivery of Photos

6.1. The Photographer provides a preview of the photos via a private online gallery link within 3 business days after the session. These photos are presented in a reduced size and watermarked. The Client has 30 days to select their preferred shots. If no selection is made within this period, the Photographer will make the selection.

6.2. The editing process takes up to 5 business days from the moment the Client confirms their selected photos.

6.3. The final photos are provided according to the package selected by the Client. Each additional photos is charged according to the price list applicable to the package. It is not possible to receive for free the remaining unselected shots (raw, without processing). 

6.4. There is an option for express editing (within 48 hours from the date of selection) for an additional fee of 50% of the chosen package price.

6.5. The Photographer does not provide RAW files; only JPG format photos are delivered.

6.6. Files are stored on disk for 3 months from the date of photo selection. After this period, the Photographer will no longer retain the unselected photos. It is not possible to purchase additional photos after 3 months from the completion of the project. The Photographer is not obliged to archive these files.

6.7. The Photographer is not responsible for any prints (photo prints) produced by photo labs that may negatively affect the final quality of the photos.

6.8. The Photographer does not provide photos on discs or other physical media. Photos are delivered to the Client through an individual download panel to be saved on their own computer at home.

7. Post-Production - Digital Editing and Retouching

7.1. The Photographer provides photography services along with basic graphic editing and retouching.

7.2. The Client may not request complex graphic alterations or AI-based retouching, such as altering their appearance—nose correction, drastic slimming, smoothing clothes, background replacement, changing facial features, adding a smile, face-swapping, or removing studio equipment from the background. Such excessive retouching often results in unnatural, artificial-looking photos and is therefore not recommended. However, it can be performed upon specific request.

7.3. The Photographer reserves the right to make any independent alterations and interference in the structure of the photos by the Client, i.e. (change of colors, retouching, application of filters - also on social networks such as instagram, facebook).

7.4. The Client acknowledges that the final digital photos provided for download may differ in color from the watermarked JPG previews they received. The selected RAW photos will undergo color correction and retouching.

8. Complaints

8.1. After selecting the photos and receiving the final digital files, the Client is required to review the photos and report any concerns within 3 business days.

8.2. The delivered photos as a final product, due to its individual nature, are not subject to returns, exchanges, complaints, grievances or other claims of this type against. 

8.3. Complaints regarding the Photographer's style (e.g., light studio color schemes) or requests for replacement of photos after the final delivery are not accepted. By participating in the photoshoot, the Client confirms they have reviewed the Photographer's portfolio and accept the presented style.

8.4. The Photographer is not responsible for the quality of lighting in the location during reportage/event sessions, weather conditions, or the engagement of models, including any lack of proper preparation such as clothing and styling.

8.5. The Photographer is not responsible for the lower technical and substantive quality of the photos in the case of clear interference of third parties such as family, priest, clergy person in the frame during reportage sessions.

8.6. The Client understands that event photos may differ from those shown in the Photographer's portfolio, which primarily features planned and styled studio shots that differ in nature from documentary photography.

8.7. In case of dissatisfaction of the Client with the submitted photos, additional processing and retouching of photos "from scratch" is priced at a fee in accordance with the current price list (50% of the price of the selected package) unless the Photographer decides otherwise.

8.8. The agreement for the photo session is considered a work contract and is subject to the provisions of Articles 627-646 of the Civil Code.

9. Privacy and Confidentiality

9.1. To book and execute the service, you must provide the Photographer with your full name, email address, phone number, and shipping address for potential print delivery. Personal data (excluding names) will not be shared with third parties or used for marketing purposes.

10. Consent for Image Publication

10.1. Sharing images from the session is crucial for any photographer as it showcases the results of their work. Client consent for publication must always be provided in writing and is entirely voluntary. I respect your privacy and will not publish any images without your written consent.

10.2. The dissemination of the image will take place for the purpose of advertising, promotion and marketing of the photographer's activities and person, in particular on websites, social media and educational courses (online and on-site).

11. Copyright and Use of Images

11.1. According to the Act of February 4, 1994, on Copyright and Related Rights, the Photographer is the author of the photos, and all copyright and proprietary rights remain with the Photographer.

11.2. Upon receiving the finished photos, the Client is granted the right to use them for non-commercial purposes, including sharing and printing. The Client may freely share the images with family and friends, copy, and print them. However, the photos cannot be sold or published in competitions without the Photographer’s written consent.

11.3. When using the photos on social media, the Client agrees to credit the Photographer by including an active link to the Photographer's profiles or by mentioning the Photographer's name in the description.

11.4. As the author of the photos, the Photographer does not consent to any modifications (such as cropping, applying filters, changing colors, adding text or graphics, etc.) without prior arrangement.
